Arcis Inc. appreciates that you care about how information about you is used and shared.  This Privacy Policy describes the privacy policy of Arcis Inc. and its mobile application and website family, including Dolphyn App, and www.dolphyn.cloud (collectively, “Dolphyn”). Dolphyn shall mean Arcis Inc., an Illinois corporation, its shareholders, directors, officers, agents, employees, successors, and assigns (referred to hereafter as “Dolphyn,” “we,” or “us” or "Arcis"). By accessing or otherwise using Dolphyn, you agree to the terms and conditions of this Privacy Policy and of the associated User Agreement. If you do not agree or are legally unable to agree to this Privacy Policy or the User Agreement, exit this page and do not access or use Dolphyn.

UPDATES TO PRIVACY POLICY

We may update or change this Privacy Policy from time to time by posting the revised Privacy Policy on Dolphyn. The revised Privacy Policy is effective immediately upon posting. You agree to be bound by any such revisions. You should periodically visit this page to determine the current terms of our Privacy Policy.

TYPES OF INFORMATION ABOUT USERS GATHERED BY DOLPHYN

The information we gather about Dolphyn users, enables us to provide you with the services you seek and helps us to personalize and continually improve our service to you. Here are the types of information we gather:

  • Information You Give Us:  We may store any information you enter on Dolphyn or provide us in any way. For example, you provide us with information when you register for an account; agree to the Terms of Use; complete a payment transaction; make an inquiry via one of Dolphyn’s applications, website, or Customer Service; reload your account balance; update your account information, generate an application or website report; or interact with Dolphyn in other ways. We may ask you to provide us with certain personally identifiable information, such as your personal name, business name, physical location, email address, phone number, credit card information (number, billing address, expiration date, issuer, and security code), home address, bank routing and account number. Some of the information we ask you to provide us is mandatory and some is voluntary. If you do not provide the mandatory information requested for a particular activity, you will not be permitted to participate in that activity.

  • Automatic Information:  We receive, analyze, and store certain types of information whenever you interact with Dolphyn whether or not you have established an account with us. For example, we may collect the device ID of the mobile device used to access one of our applications.  We use this information to personalize yourexperience and to enhance the safety of our service. We may also collect the Internet protocol (IP) address used to connect your computer or mobile device to the Internet; your login and email address; information about your browser and operating system; and the Uniform Resource Locators (URLs) of the websites you visited before and after Dolphyn. We also place cookies and other anonymous identifiers on your computer or smart phone. A cookie is a small piece of information that a website can send to your browser and may then be stored on your computer’s hard drive. An anonymous identifier is a random string of characters that is used for the same purposes as a cookie on platforms, including certain mobile devices, where cookie technology is not available. You may be able to block, delete, or disable such cookies or anonymous identifiers, but doing so may prevent you from taking advantage of some or all Dolphyn services. We additionally may use software tools, such as web beacons, to collect information about how Users move about and use Dolphyn.

  • Information from Other Sources:  We may combine information you provide us or that we obtain automatically with information from third parties to correct our records, personalize your experience, or enhance our services.  This may include, but is not limited to, information from our service providers.

HOW DOLPHYN SHARES THE INFORMATION IT RECEIVES

Information about our users is a critical part of our business.  We do not sell personally identifiable information to others, but we may share User information with others in the following ways:

  • With Authorized Third Party Service Providers:  We employ other companies and individuals to assist us with operations, such as processing payments, analyzing data, and providing marketing assistance, and we may provide your personally identifiable information with these parties as necessary for them to perform the services for which they have been contracted. 

  • With Third Party Advertisers and Other Websites:  In the future, we may permit Third Party Advertisers to display advertisements when you visit Dolphyn, and Dolphyn may include links to other websites. If and when we permit such Third Party Advertisers and website links, we may share aggregated, non-personally identifiable information with these Third Party Advertisers and other websites. When you access the ads Third Party Advertisers place on Dolphyn, their websites may send their advertisements directly to your browser or mobile device; they may also use cookies and other technology to measure the effectiveness of or personalize their advertisements and links. We do not have access to and cannot control technology used by Third Party Advertisers and linked websites, and their information practices are not covered by this Privacy Policy. We encourage you to review their posted privacy policies. You may obtain information about Internet advertising companies, including how to opt out of their information collection, by contacting the Networking Advertising Initiative at http://www.networkadvertising.org/managing/opt_out.asp.

  • To Parent or Affiliated Companies:  While we currently do not have a parent company, subsidiaries, or any other companies under a common control, we may in the future, and we may share your personally identifiable information with these companies, in which case we will require them to honor this Privacy Policy.

  • In a Change of Ownership:  As we continue to develop our business, we might merge with or be acquired by another company.  If this happens, the successor company could acquire the information we maintain, but personally identifiable information would remain subject to this Privacy Policy.

  • For Dolphyn’s Protection or the Protection of Others:  We may disclose your personally identifiable information if we believe in good faith that such disclosure is necessary to comply with the law or a court order; enforce Dolphyn’s User Agreements or other agreements; or protect the rights, property, or safety of Dolphyn, our Users, or others.  

SECURITY OF YOUR INFORMATION

When Dolphyn collects and stores your personally identifiable information, as outlined above, we use tools such as encryption, passwords, and physical security to protect Users’ passwords, PINs, bank account, and credit card information against unauthorized access and disclosure. Credit card information is stored in a PCI compliant third party database. Dolphyn does not have access to your credit card information except for last 4 digits of the card. All other personally identifiable information is stored in Dolphyn’s database hosted within an ISO 27001 compliant data center. To protect the security of your personally identifiable information during transmission, we use Secure Sockets Layer (SSL) software, which encrypts this information. When you provide us with personally identifiable information, however, you acknowledge that, even with industry standard security measures in place, third parties might unlawfully intercept or access transmissions or private communications.

MANAGING YOUR INFORMATION

You have options for managing your personally identifiable information on Dolphyn:

  • You can add to, update, or delete certain information after you establish a Dolphyn account. This includes, but is not limited to, changing your password, your credit card or bank account information etc.  When you update information, we may electronically store the prior version of your information.

  • You may also change your email address by contacting Dolphyn Customer Service via email.

  • For additional information on how to update or change your account information, please see Dolphyn’s User Agreements.

  • As a condition of having an account on Dolphyn, you agree to receive from us administrative emails about your activity on Dolphyn and announcements about new features or changes to Dolphyn. 

  • If you have provided your email address to a Dolphyn Third Party Advertiser and no longer want to receive emails from that Third Party Advertiser, you must notify directly that advertiser.

If you no longer want to use Dolphyn, you may close your User account.  Consumers may do so via the mobile app or by sending email to support@dolphyn.cloud.
